Charges have been filed against a male suspect shot by an HPD officer in the 4700 block of Tidwell Road about 1:40 a.m. on Sunday (January 11).
The suspect, Sergio Almaza, 24, is charged with aggravated assault against a public servant in the 248th Criminal District Court. A 2025 booking photo of Almaza, who remains hospitalized, is attached to this news release.
HPD Officer R. Gutierrez, who discharged his duty weapon, was not injured in the incident. Officer Gutierrez is assigned to the Northeast Patrol Division and was sworn in as an officer in January 2024.
HPD Homicide Division Special Investigations Unit Sergeant M. Glover and Detective K. Vu. reported:
Officers initiated a traffic stop on a vehicle for a traffic violation at the above address. The male driver did not produce a valid ID and was asked to step out the vehicle by officers. Officers were able to verify the driver’s identity and learned he had outstanding warrants, including a felony.
As officers attempted to take the suspect into custody, a struggle ensued. During the struggle, one officer discharged his taser. The suspect continued to resist after being tasered and an officer discharged his weapon striking the suspect.
Responding Houston Fire Department paramedics transported the suspect to an area hospital in critical condition.
Detectives consulted the Harris County District Attorney’s Office and the suspect was subsequently charged.
As is customary in officer involved shooting incidents, the case is being investigated by the HPD Homicide Division, the Internal Affairs Division and the Harris County District Attorney’s Office.
